The Food Safety and Standards Authority of India (FSSAI) is the official regulatory body responsible for granting food licenses to all food business operators (FBOs) in India. In accordance with Section 31(1) of the Food Safety and Standards Act, 2006, it is mandatory for every Food Business Operator in the country to obtain a license from the Food Safety & Standards Authority of India (FSSAI). The process and requirements for FSSAI licensing and registration are governed by the Food Safety & Standards (Licensing and Registration of Food Business) Regulations, 2011. This legal framework ensures that food businesses in India comply with food safety and quality standards.

Food Business Operators Who Require FSSAI Registration?

Food Business Operators (FBOs) engaged in the following types of food businesses are required to obtain an FSSAI License or Registration:

FSSAI Registration/FSSAI License

FSSAI registration is tailored to specific business types, taking into account their turnover and production capacity. Depending on these factors, Food Business Operators (FBOs) may qualify for essential, central, or state licenses, ensuring that the regulatory requirements are aligned with the scale and nature of their food-related activities.

FSSAI Registration

FSSAI Registration is mandatory for petty food manufacturers or the FBO having a turnover of less than Rs.12 Lakhs unless the FBO is covered under compulsory licensing.

Small food business operators (FBOs), including those involved in the production or sale of food items, as well as hawkers, small retailers, itinerant vendors, temporary stall-holders, and small-scale food industry businesses, are required to obtain an FSSAI registration certificate if they meet the following conditions.

The FSSAI registration number is issued by the State Licensing Authority and consists of 14 digits, with the first digit always starting with "2." This unique number helps identify and track food businesses registered under the Food Safety and Standards Authority of India.

FSSAI License

FSSAI License is obligatory for businesses with a turnover exceeding 12 lakhs or those engaged in food processing and manufacturing. The FSSAI License is classified into two categories: Central and State License. FSSAI licenses are identified by 14 digits, with the first digit commencing with "1." The selection between a state or central license depends on the business's scale and nature.

State license

Medium-sized food processors, manufacturers, traders, marketers, or transporters need to obtain the FSSAI state license from the respective state government. An FBO falls into the category of a medium-sized business when its annual turnover is greater than Rs.12 lakh but does not exceed Rs.20 crore. In this case, acquiring a state license is mandatory. However, when the FBO's annual turnover exceeds Rs.20 crore, they are required to secure a central license.

Central license

Large-sized food businesses involved in the processing, transportation, manufacturing, and international trade of food products are required to obtain the FSSAI central license. An FBO is classified as a large business when its annual turnover surpasses Rs.20 crore, making it mandatory to acquire an FSSAI central license from the Central Government.

A new notification from the Food Safety and Standards Authority of India (FSSAI), dated 19th March 2021, introduced a category-wise list of documents for FSSAI license applications, renewals, and modifications. Procedure to Apply for FSSAI License and Registration

The process to get the FSSAI License and Registration through the FoSCoS portal is explained in detail below

Step 1: Visit the official Food Safety and Compliance System (FoSCoS) webpage and click on the “signup” option located at the top right corner of the homepage.

Step 2: Once you click “signup,” you will be directed to the signup page. Fill in all the required details, including Name, Email ID, Mobile Number, Login ID, and Password. Then, click on the “Signup” button.

Step 3: A verification code will be sent to the email and mobile number you provided during signup. Enter this verification code in the designated box and click “Submit” to confirm your details.

Step 4: After successfully signing up and verifying your information, you can access the portal by entering your username and password.

Registration of Petty Food Business Operators

After login into the portal, click on the “Apply for Registration Certificate (Petty Food Business Operators)” option. After the verification of OTP, select the application for the New Registration option. A new application page will open, provide all details in the application for registration of Petty FBO and submit the application.

Procedure for New Application (Registration/License)

Once you’ve logged into the portal, follow these steps to apply for a new FSSAI License/Registration:

Step 1: Access the dashboard and select “License/Registration” in the left menu. Choose “Apply for New License/Registration.”

Step 2: Pick your State and carefully read the provided notes.

Step 3: Review the Group Heads for the Kind of Business. Select “Restaurant” from the Food Services Business Group Head.

Step 4: Based on your food business turnover, choose the appropriate radio button and proceed with the application.

Step 5: Fill in all the mandatory fields as indicated in Application Form B.

Step 6: Be cautious while providing communication details since official correspondence will be directed to the contact details, such as Mobile Number or Email ID.

Step 7: Upload the required set of documents and make the fee payment using the available payment modes. Then, click “apply.”

Step 8: After completing the fee payment, a receipt will be generated, providing you with a 17-digit reference number for future reference.

Procedure for Renewal

Food Business Operators (FBOs) can request the renewal of their existing licenses/registrations using the Renewal tab. It's crucial to submit the renewal application within the timeframe of 120 days to 30 days before the current license's expiration date. Once the FSSAI authorities approve the application and issue the FSSAI registration certificate, the status will be updated to 'Registration Certificate Issued.' To access the certificate, applicants can simply log into the FoSCoS website for download.

FSSAI Penalty and Offenses

The FSSAI Act imposes penalties and offenses to ensure the availability of safe and wholesome food for human consumption. Individuals or food business operators who are required to obtain a license and engage in the manufacturing, sale, storage, distribution, or import of any food article without the necessary permit can face penalties. Such contraventions can result in imprisonment for up to six months and fines of up to five lakh rupees, except for those exempted from licensing under section 31(2) of the Act. These measures are in place to uphold food safety standards and protect public health.
