REFFERAL POLICY

WE RECOMMEND THAT YOU READ OUR POLICIES CAREFULLY AND KEEP UPDATING YOURSELF FOR CHANGES.

This Referral Policy (“Policy”) applies to the Indirect Earnings from Refer and Earn Program conducted on our Website and Application (collectively referred to as the “Platform”) owned and operated by BMCS India Private limited, a company registered under the laws of India (hereinafter referred to as the “Company” “Us” “We” & “Our”). 

The Company reserves the right, at its sole discretion, to change, modify, add or delete portions of this Policy, at any time without any prior written notice to you (“You”, “User”, “IBE”, or “Yourself”). It is Your sole responsibility to review this Policy periodically for updates or changes. Your continued use of the Platform following the posting of changes shall be deemed to mean that you accept and agree to the revisions of this Policy.

We are delighted to introduce our enhanced Refer and Earn Program that not only benefit You but also rewards Your network up to 15 levels deep. Please carefully read the terms and conditions outlined in this Policy.

This Policy shall be read in reference to the Privacy Policy, Terms of Use, and any other legal documents that the Company may periodically update on the Platform.

TERMS AND CONDITIONS 

For the purpose of this Policy, wherever the context so requires, the term:

    • Application” means the official Company Apps for iPhone and Android, which can be downloaded from the App Store or the Google Play Store.
    • IBE or Independent Business Entrepreneurs” means individuals or legal entities registered on the Platform to provide services to the Company and earn income;
    • Direct Earning” refers to all the commission earnings obtained from working as an IBE for the Company;
    • Indirect Earning” refers to all earnings obtained through Bureau Points by participating in the Refer and Earn Program;
    • Bureau Points” refer to the indirect earnings measured in points obtained through the Refer & Earn Program for which the conversion rate is 10 BPs (Ten Bureau Points) being equal to INR 1 (Indian Rupees One Only/-);
    • Bureau Cash” refer to the amount earned by IBE via Direct Earning.  
    • Bureau Limit” means amount limit which can be withdraw from Indirect Earning / Bureau Points;
    • Refer and & Earn Program” refers to a program that rewards You with Bureau Points for inviting your friends, family, and business partners to register as an IBE on our Platform.You i.e., the Referrer can earn Bureau Points by signing up with us using the provided Code and Complete any Project from our Platform;
    • Referral Code” refers to a unique identifier or alphanumeric sequence assigned to each IBE to participate in a Refer and Earn Program, enabling them to refer others and track new participants;
    • Referee” means the person who registers as an IBE on the Platform using Referral Code; 
    • Referrer” means an IBE who refers his friend, acquaintances, business partners etc., to register with Us on the Platform.
    • Website” means www.bmcsindia.in, and mobile optimized version of the website and all related functionality offered by or for the Company on or through our Website or Mobile App. 
  • JOINING BONUS
    The Joining Bonus comprising 10,000 Bureau Points will be credited to the Bureau Points of the new User upon the successful registration as an Independent Business Entrepreneur (IBE) on the Platform. 

ELIGIBILITY TO PARTICIPATE

    • To participate in the Refer & Earn Program, you must be a registered IBE on our Platform.
    • Participants must be 18 years of age or older and capable of entering into a contract under the Indian Contract Act, 1872.
  • 15 LEVEL WISE INDIRECT EARNING FROM REFER AND EARN PROGRAM
    • Referral structure designed as a multi-tiered system, offering Indirect Earnings to both Referrers and Referees across a depth of 15 levels.
    • The current allocation for the total distribution of Indirect Earnings stands at 40%, with the flexibility for adjustment by the Company. 
    • Following is the structure for distribution of Indirect Earnings:

Level 1: 20%

Level 2: 10%

Level 3: 3%

Level 4: 2%

Level 5: 1.5%

Level 6: 1%

Level 7: 0.5%

Level 8: 0.25%

Level 9: 0.25%

Level 10: 0.25%

Level 11: 0.25%

Level 12: 0.25%

Level 13: 0.25%

Level 14: 0.25%

Level 15: 0.25% 

    • Throughout levels 1 (one) to 15 (fifteen), Referrers will continue to accrue Bureau Points as their Referees expand the referral network. This means that an IBE i.e., Referrer will receive indirect earnings as their Referee refers to others, and the cycle continues up to the fifteenth person.
    • Illustration: Imagine You refer a friend (Referee 1), and Your friend work for the Company on any Project where He/She has earned 1,00,000 Rs. You get a cool 20% of his/her earning in Bureau Points which is equivalent to 2,00,000 BP or 20,000 Rs. This sharing of points keeps happening for each new person referred, creating a chain that goes all the way up to Level 15. Each time someone new joins, the original Referrer gets a slice of the points pie. It’s like earning bonuses for introducing friends, and it keeps rolling!

 

    • Notwithstanding anything contained in this Policy the Company reserves the right to cancel / change / add / delete the terms and conditions of this Clause 3 at its own discretion without notice. Users are strongly advised to stay informed about any cancellations, changes, additions, or deletions. The Company disclaims any liability arising from the lack of User awareness regarding such modifications.
    • The Company reserves the right to deny honoring offering Bureau Points to an IBE on the grounds of suspicion or abuse of the Refer and Earn Program.
  • BUREAU LIMIT 
    • The Bureau Limit imposes a 25% withdrawal limit. IBE is eligible to withdraw 25% of their Indirect Earnings if they have earned an amount from the Direct Earning program equal to their Indirect Earnings.
    • For example, if you have accumulated 10,00,000 Bureau Points, equivalent to INR 1,00,000/- from our Refer and Earn Program, and concurrently earned INR 1,00,000/- from the Direct Earning program, you are entitled to withdraw 25% (Twenty Five Percent) of the total amount from your Indirect Earnings by converting Bureau Points into cash i.e. amount equivalent to 25,000/-. 
    • This withdrawal can be effortlessly accomplished by converting your Bureau Points into cash, allowing you to cash out an amount equivalent to INR 25,000. This adds a rewarding dimension to your earnings journey, providing tangible benefits from both our referral program and direct earnings initiative.
  • CONVERSION OF BUREAU POINTS INTO CASH
    • To convert Bureau Points into cash, an IBE must follow the designated procedure outlined herein.
    • Subject Clause 4 of this Policy, IBE can request, by accessing a specific section on the Platform, to convert their Bureau Points into cash by providing necessary details as requested by the Company for withdrawal and adhering to any additional authentication processes.
    • The conversion rate for Bureau Points to cash is in accordance with the prevailing rate set by the Company. This rate may be subject to periodic adjustments, and it is the responsibility of the IBE to stay informed about any changes.
    • The Company reserves the right to modify the conversion process, including but not limited to withdrawal limits and associated fees. Such modifications will be communicated to the IBE through the Platform, and it is the IBE’s responsibility to review and comply with the updated procedures.
    • Upon successful completion of the Bureau Points to cash conversion process, the funds will be credited to the IBE’s designated bank account.
    • The Company shall make reasonable efforts to process the conversion requests promptly. However, processing times may vary based on factors such as transaction volume, technical considerations, and any unforeseen circumstances. The IBE acknowledges and understands these factors.
    • While we strive to provide a seamless conversion process, it’s important to note that the Company retains the right to deny Bureau Points conversion requests under certain circumstances. These circumstances may include without limitation suspected fraudulent activities, violations of the terms outlined in the Refer and Earn Program, or any breach of the Platform’s Terms of Use.
    • This measure is in place to safeguard the integrity of our programs and ensure fair and ethical engagement. The Company is committed to maintaining a secure and trustworthy environment for all Users. Should there be any concerns or suspicions of misuse, appropriate actions, including the denial of conversion requests, will be taken to protect the Company and its community of Users.
    • It is the responsibility of the IBE to ensure that the information provided during the Bureau Points to cash conversion process is accurate and up to date. The Company shall not be liable for any issues arising from inaccurate or outdated information provided by the IBE.
    • The Company may charge reasonable fees for processing Bureau Points to cash conversions. Any applicable fees will be clearly communicated to the IBE, and the IBE must agree to such fees before initiating the conversion process.
  • EXPIRATION of BUREAU POINTS
    At the end of 31st March of every year, all the Indirect Earning i.e. Bureau Points earned through Refer and Earn program will be lapsed if not used. 
  • INDEMNIFICATION AND LIMITATION OF LIABILITY
    • User agrees to indemnify, defend and hold harmless the Company, its affiliates and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-performance of any covenant of this Policy by the User.
    • The User shall be solely liable for any breach of any country specific rules and regulations or general code of conduct and the Company cannot be held responsible for the same.
    • In no event shall the total liability of the Company, whether in contract, tort (including negligence or strict liability), or otherwise, arising out of or related to this Policy exceed the aggregate amount of INR 2,000/-.  
    • Notwithstanding anything contained in this Policy, under no circumstances shall the Company be liable for any consequential, indirect, special, or incidental damages, including, but not limited to, loss of profits or revenue, business interruption, or loss of data, even if advised of the possibility of such damages.
  • MISCELLANEOUS 
    • Amendment. The Company reserves the right to amend, modify, or update this Referral Policy at its sole discretion. Users are encouraged to review the policy periodically for any changes. Continued use of the Platform after the posting of modifications constitutes acceptance of the updated Policy.
    • Governing Law and Jurisdiction. These Policy shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall exclusively be in Noida, Uttar Pradesh, India. In the event of any dispute arising out of these Policy the same shall be settled by a binding arbitration conducted by a sole arbitrator, appointed jointly by both parties and governed by the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be at Noida, Uttar Pradesh, India.
    • Severability. If any provision of this Policy is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.
    • No Waiver. The failure of the Company to enforce any right or provision of this Policy shall not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of the Company.
    • Entire Agreement. This Policy, in conjunction with the Privacy Policy, Terms of Use, and any other relevant legal documents on the Platform, constitutes the entire agreement between the You and the Company concerning the Refer and Earn Program.
    • Contact Information. Users are responsible for maintaining accurate contact information, including email addresses and phone numbers, to ensure effective communication regarding the Refer and Earn Program. The Company shall not be held liable for any consequences resulting from outdated or inaccurate contact details.
    • Force Majeure. The Company shall not be liable for any failure or delay in the performance of its obligations under this  Policy due to acts of nature, strikes, riots, war, terrorism, governmental action, or any other force majeure event beyond its reasonable control.
